In Tennessee, a significant number of serious injuries occur as the result of dangerous conditions or defective products.

Defective Products can cause injuries or death in a wide variety of circumstances: at home or in the workplace; in factories or construction sites; in the course of travel, or engaging in recreational pursuits. A product can be defective in three basic ways, including: (1) Defective in its design; (2) Defective in its manufacture; or (3) Defective in its warning label (by giving insufficient warning of potential dangers or side effects involved it its use)

Some of the product liability suits we handle involve:

• Prescription drugs that do not warn of dangerous side effects. For example, many users of the pain and arthritis medication, Vioxx, were not warned of the higher risk for heart attack or strokes that long-term use posed. Vioxx, a very profitable prescription drug manufactured by Merck, was voluntarily recalled from markets worldwide in September 2004 after a study revealed the increased risks associated with its use.

• Defective autos or automotive parts. For example, design defects in some SUVs make them more subject to rollover accidents. SUV rollovers and tire defects that cause blowouts at high speeds are a serious cause of catastrophic injuries in car accidents . When a rollover crushes the roof of an SUV, horrific injuries such as a broken neck, or massive head injuries, including brain trauma, often ensue.

• Dangerous or defective toys. Toy manufacturers do not often consider the various and sundry ways a child may think of to play with a toy. This lack of imagination on the part of toy manufacturers often causes serious injuries to children who are not old enough to anticipate the dangers a toy might present.
