A Whitchurch-Stouffville family is facing the unthinkable after a reckless driver claimed the life of 35-year-old husband and father, Andrew Cristillo, on August 3, 2025. Andrew was driving home from a family gathering with his wife, Christina, and their three young daughters — Leah (7), Chloe (6), and Ella (4) — when their vehicle was allegedly struck head-on by 18-year-old driver, Jaiwin Kirubananthan.
Andrew died instantly. Christina, who is battling stage four breast cancer, suffered injuries herself while rescuing her daughters from the wreckage, and who is now the sole provider and caregiver for their daughters. The three girls also sustained injuries and endured the trauma of witnessing their father’s death.
The accused driver fled the scene but was later arrested and is facing multiple criminal charges, including dangerous driving causing death, dangerous driving causing bodily harm, and failing to remain at the scene.
This was not the driver’s first encounter with the law — earlier this year, he was charged in another dangerous driving incident involving an Ontario Provincial Police vehicle in which Ontario Premier Doug Ford was a passenger.
While the criminal justice system addresses the accused’s conduct, the family is also entitled to seek justice through the civil justice system to help them recover financially and safeguard their future. Potential claims may include:
Wrongful Death Claim – Seeking damages for the loss of Andrew’s guidance, care, companionship, and financial support.
Family Law Act Claims (Ontario) – Entitling eligible family members (spouse, children) to damages for loss of care, guidance, and companionship, as well as reimbursement for funeral expenses and other related costs.
Claims for Pain and Suffering – For Christina and the children’s physical injuries and emotional trauma from the collision.
Loss of Income and Earning Capacity – For the income Andrew would have provided over his lifetime, and for any loss of Christina’s earning ability due to her injuries and illness.
Household and Childcare Services – Compensation for the cost of services Andrew would have performed, and additional care expenses now required.
Accident Benefits – Coverage under Ontario’s Statutory Accident Benefits Schedule (SABS), including medical/rehabilitation benefits, income replacement, attendant care, and psychological treatment for trauma.
