Dogs are cherished domestic animals, but accidents can happen. There are over 5,000 dog bites each year in Ontario, with 1-2 fatalities each year.
Immediately after a dog bite, you need to:
- Assess your injuries – If severe, call for an ambulance or go immediately to the hospital. If minor, attend a walk-in clinic or hospital to properly cleanse and bandage the area.
- Identify the Dog and the Owner –gather key information from the owner of the dog breed and vaccine history. If possible, obtain the dog license number from the dog tag.
- Document the incident –take photos of the location, the dog, and your injuries. Notify the police, the local government public health institution, and the local animal control authority. If there are witnesses, get their contact information and get statements from them.
- Save all expenses/proof – including medical costs, transportation expenses and time off work.
- Contact a lawyer for advice.
One thing about dog bite incidents is that they are strict liability cases. You do not need to prove negligence on the dog owner to get a finding of negligence.
Another thing about dog bite incidents is that the home insurance company of the dog owner is the one who ultimately pays a settlement or award at trial.
