Surveillance in Personal Injury claims

Security cameras

During a personal injury lawsuit, Defence counsel often will rely on surveillance videos or photographs to cast doubt on the Plaintiff’s credibility. The surveillance video and photographs are hoping to catch the Plaintiff performing activities that are inconsistent with your particular injury.

Defence will have access to your home address, license plate number and employment address and will therefore be able to follow you and conduct surveillance from a distance.

Defence will also review Plaintiff’s social media accounts. Defence will hire a private investigator who will send a friend or follow request in order to investigate a Plaintiff’s social media accounts.

The purpose of this type of investigation is to assess a Plaintiff’s limitations post-injury and catch the Plaintiff in a compromising position which hurts his/her credibility.

Credibility is the cornerstone of a case in litigation. Without it, a Plaintiff is doomed to fair in his/her case.

Be aware of these defense tactics.
